CLE Tech Ops Seniority Integration Survey

The results of the survey will be used by Brad to convey Cleveland's position of a combined workforce seniority list. Your opinion matters! Airline Division Week In Review - January 29, 2012

Citation Air Negotiations Begin
The Citation Air pilots negotiating committee met January 10th – 12th, for bargaining with management at corporate headquarters in Greenwich, Connecticut. International Representative Rick Dubinsky reports that consistent with the previous bargaining sessions for this newly organized pilot group, the atmosphere during negotiations was cordial, professional and productive.  Important progress was made on certain documents and understandings between the parties, the most important of which was a Memorandum of Understanding (MOU) regarding the Aviation Safety Action Program (ASAP). Negotiations will resume next month when the parties next meet February 7th 9th, again in Greenwich, Connecticut.

XJT Negotiations Update
This week marked the first week of negotiations with the participation of a Federal Mediator.
The Mediator met separately with both parties and there were also face to face meetings with proposals exchanged. Tentative Agreement was reached on Section 21- System Board of Arbitration.  The Union also presented their proposal on Moving Expenses. The company has informed the union that they do not feel obligated to accept the previous tentative agreements that have been reached on various contract sections. While the union believes these previous tentative agreements to be reasonable and the companies’ insistence on this approach will slow down the process of obtaining a fair successor contract; if the company insists on introducing new proposals on previously agreed upon issues, the union will bargain with the company in good faith. This would also mean that the union would also be free to introduce new proposals. The Company has indicated that it wants to give the Union and its negotiating committee an updated financial presentation; the parties are discussing the scheduling of the meeting. The Mediator has scheduled the next round of negotiations for February 15th, 16th and 17th in Philadelphia.

US Airways confirms that it is looking into a merger with American Airlines…American Airlines said employees whose pension plans are vested will not have their benefits reduced despite the bankruptcy filing by the carrier's parent company, AMR Corp…DHL Express USA plans to expand operations at the Cincinnati/Northern Kentucky International Airport…Flight Attendants at USAirways Express could go on strike…The pilots union for Air Canada says the carrier has turned its back on federal conciliation…Flight Instructors at Southwest and AirTran have reached a deal on seniority.
Republic Airways Holdings appointed David Siegel as CEO, president and interim chief operating officer of Frontier Airlines. Republic has said it is considering selling or spinning off Frontier Airlines. Siegel previously served as CEO of US Airways Group.

NMB Confirms IAM Intimidation and Misconduct during UAL/CAL Fleet Service Vote
Following the UAL/CAL Fleet Service election in August 2012, which the IBT narrowly lost to the IAM, the IBT filed an election protest with the National Mediation Board on the basis that fair election rules were violated by the IAM when they intimidated employees and by secretly linking to the NMB's voting website from its webpage. In the IBT's view, the IAM's actions violated employees' rights to a secret vote and to be free of unfair interference. The IBT requested that the Board conduct a full investigation of the IAM's actions.
On January 17, 2012, in a letter to the parties, NMB General Counsel Mary Johnson wrote that the IBT's protest presented enough evidence of interference to warrant a full NMB investigation, including interviews of witnesses to the IAM's actions.
While the Board does not always take such steps in response to allegations of interference; its willingness to investigate this matter shows that the IBT has demonstrated that there are serious concerns with the fairness and secrecy of the election. Ultimately, after a full election, the NMB could order a rerun election to be conducted under conditions that ensure fairness and secrecy.
Upon notification of the finding, Airline Division Director David Bourne said, "We are confident that when the NMB conducts its investigation, it will find further evidence confirming serious incidents of interference by the IAM. What the IAM did in the Fleet Service election; most importantly its inclusion of a secret link to the voting website in spite of a clear NMB prohibition on doing so; tainted the election and certainly resulted in the Fleet Service craft having IBT representation stolen from them."
“We will keep our membership updated as the NMB investigation proceeds," he concluded.
Express Jet/ASA Stock Clerk Negotiations Continue
The XJT/ASA Steering Committee met on January 10th and 11th to discuss future negotiations with the Company. Monica Horne (RIC), Jeremy Keeble (TYS), Kermit Morrell (ATL), Verena Riese (IAD) and Chris Lomeli (IAH) who comprised the Rank and File members of the steering committee were joined by the IBT negotiating team at the meeting. Lead Negotiator and Local 210 Business Agent Bob Luciano, IBT Attorney Nick Manicone, Airline Division Representative Chris Moore and Local 19 Business Agent Mike Cline discussed issues of importance to the members as well as the differences in the work rules at the respective Airlines.
Negotiations continued on January 16th and 17th.  Work was continued from the previous session and Tentative Agreement was reached on two contract sections, Grievance Procedure and System Board of Arbitration. Additionally, the parties were able to reach agreement on the contract section that will deal with Seniority.
Once tentative agreements are completed on all the proposed contract sections, the full Tentative Agreement will be submitted to the membership for ratification.
Negotiations Continue at Continental Micronesia
The past week’s meetings concluded with the parties focused on the intent of concluding negotiations for the sub Continental Micronesia mechanics agreement. The parties discussed the remaining open economic items including health care, retirement, wages and job protection provisions from Monday the 16th until Wednesday the 18th. Significant progress was reported towards achieving the goals that would provide the membership with an acceptable agreement.
The Negotiating Committee remains determined to put the CMI membership in a position of equity with the agreements previously reached with both the sub Continental and sub United mechanics. Future negotiation dates are yet to be determined, but the parties are committed to completing this process in the most expeditious manner possible.

The XJT / ASA Steering Committee met on January 10th and 11th to discuss future negotiations with the Company. Rank and File members of the Steering Committee; Monica Horne (RIC), Jeremy Keeble (TYS), Kermit Morrell (ATL), Verena Riese (IAD) and Chris Lomeli (IAH)were joined by the IBT Negotiating team lead negotiator Bob Luciano (Business Agent-Local 210), IBT Attorney Nick Manicone, IBT Airline Divison Representative Chris Moore and Mike Cline (Business Agent-Local 19) to discuss issues of importance to the members as well as the differences in work rules at the respective airlines. The committee has a very busy schedule as they prepare for the next round of negotiations that resume on January 16th and 17th in Atlanta.

The U.S. Chamber of Commerce is urging Congress to take action on NextGen by dropping a labor provision holding up the passage of reauthorization for the Federal Aviation Administration. "A new NextGen air traffic control system must be a top priority," said Tom Donohue, president of the chamber…The National Mediation Board has scheduled a meeting for American Airlines and three of its unions.

American Eagle hasselected Bain and Co. as their labor advisor…A merger with AMR would carry major opportunities for the eventual winner, thanks to American's significant network in the U.S. and internationally.
Pension plans for AMR Corp. The Wall Street Journal, but American Airlines faces pressure to continue funding its pension…US Airways Group and the US Airline Pilots Association have agreed to drop a lawsuit over work slowdowns by pilots…The creditors committee for AMR Corp. is awaiting a plan for the parent company of American Airlines to emerge from bankruptcy. The committee is made up of representatives from three unions, three banks and three companies.
Pinnacle Airlines has proposed a 5% cut in wages for its flight attendants as part of a restructuring plan. The carrier has asked the union representing the attendants to consider the proposal and make a decision by Monday.
Boeing deliveries of commercial aircraft increased by 10% in the fourth quarter of 2011, the company has announced.
Airlines for America has taken over the Airline Industrial Relations Conference, a nonprofit dedicated to airline labor issues.
The demand for maintenance, repair and overhaul work on wide-body aircraft has grown 2% since last year, outpacing demand for MRO services for narrow-body aircraft.

Moving Forward…What Comes Next? Since the sub UA membership accepted the terms of their agreement on December 29th, steps are underway to begin the work of amalgamating the agreements into ajoint collective bargaining agreement.1. To complete the process of individual agreements for all three subsidiaries, theparties are meeting the week of January 16thto complete the Continental Micronesiaagreement. The goal is to finish this agreement during this session.2. The Principal Officers and Business Agents of all the pertinent Locals are slated to meet in early February to discuss the integration process. At this meeting items will bediscussed regarding the make-up of the Steering, Negotiating and Seniority Integrationcommittees.3. Information requests will be (in some cases already have been) made of thecompany for pertinent information associated with seniority lists as well as medical andpension plan data to be made available to the various committees.As the process unfolds the membership will be updated through the Airline Division’s“Week in Review,""The Mechanics DispatchSub UA Transition Items," various Local and International websites,bulletin boards in the workplace, and email blasts to those members that have signedup to receive them. There areweekly calls with these Representatives to ensure they have the most accurate and upto date information.Work continues to complete the transition into the new agreement. The big item thisweek is holiday pay for January 1st. The time and a half premium along with pay rateswere Day One items and members should be paid according to the new rates in theratified agreement. A problem arose when payroll interpreted the transition documentsincorrectly and then allowed the program to pay straight time as the premium asopposed to time and one half. Members affected by this will most likely see anadjustment in the next check following the holiday check if the correction can’t be made in time.401(k) ContributionsIt was reported in the last update that members are limited to 30% of their signingbonus going to the 401(k). There is a way through supplemental deductions toincrease the amount. Members are advised to call Fidelity directly at 1-800-245-9034.When talking to the Fidelity adviser for calculating the additional contributions, beaware that the signing bonus will be paid the same day as the regular pay check on1/26 and both checks will be subject to the same supplemental deductions.Benefits Committee MeetsThe sub CO benefits committee met in Florida last week. Members from sub UAattended the meeting to listen in and learn from the process. A full report of thecommittee is not available as of the writing of this article but will be ready for next week’s Dispatch.Continuing Compliance IssuesMembers are advised to be aware of the constantly changing paperwork. Ensure you have the most current paperwork to avoid problems with the FAA. If you do find that the wrong paperwork was used please fill out the MSAP/ASAP and NASA forms. Pleasealso immediately contact your Local flight safety representative to guide you throughthe process. Members will be helped through the process and if the issue is raised to the point of receiving a letter from the FAA the license protection program is in placefor further protection.Sub UA Physicians Choice FormsArticle 14, paragraph H of the new agreement retains the language of the oldagreement for physician’s choice for work related injuries. If the member has their personal physician on file prior to injury they may select to use them instead of thestate panel doctors for occupational injuries.
